The following Lease Agreement may be subject to change at any time. Lease will be provided to the Hunter by the Landowner.
This Hunting Lease Agreement (“Lease”) is entered by and between Steve Kollodge (“Landowner”) and ________________________ (“Lessee”) on ____________ (date). Landowner and lessee(s) may collectively be referred to as the “Parties.”
The Parties agree as follows:
The Landowner agrees to grant the Lessee the right to hunt, shoot and harvest wildlife on the Property to be leased, as described herein, and in compliance with the laws and regulations of the United States and the State of Minnesota. Hunting practices will be carried out on the tract of land described as follows:
137 Acres of Land located at the South Half of the Southeast Quarter, except 1179 feet of the West 850 feet thereof, Section Nine, Township 40, Range Twenty-Three, Kanabec County, Minnesota.
Referred to as the “Leased Property” or “Property”
PURPOSE: Lessee(s) may only use the Leased Property exclusively for the purpose of hunting Whitetail Deer, Turkey or Black Bear as authorized below. It may not be used for other purposes unless otherwise stated in this Agreement. This Agreement grants the Lessee the following privileges: (Circle Yes or No to all that apply)

Yes / No - Accessing the property by foot using designated access routes.
Yes / No - Temporary installation of ground blinds, portable tree stands and removable
tree steps. No bolts, screws, spikes, nails, etc. are allowed for tree steps
Yes / No - Tree branch and brush removal for the facilitating of shooting lanes. Excessive
branch and brush removal is NOT allowed, removal of trees greater then 2
inches in diameter is NOT allowed.
LEASE TERM AND PAYMENT: Lessee agrees to pay Landowner rent for the use of Property in the amount of $X.XX for a term commencing on Date, 2024 (the “Commencement Date”) and ending on Date, 2024 (the “Expiration Date”). A 50% deposit of the Lease Amount is due upon making a lease reservation. This deposit is non-refundable. The balance of the Lease Amount is due 14 days prior to the start date of the lease. If the balance of the Lease Amount is not paid in full 14 days prior to the lease start date, the Lease is automatically cancelled. This lease shall automatically terminate on the date specified or upon the successful harvest of a maximum of two deer, one bear or one turkey as identified in the section above.
SURRENDER OF PROPERTY: Upon the expiration of the term hereof Lessee(s) shall surrender the Leased Property in as good a state and condition as it was at the commencement of this Agreement, reasonable use and wear and tear thereof and damages by the elements excepted and that all temporary hunting equipment including all portable tree stands, tree steps, blinds, etc. be removed.
COMPLIANCE WITH LAW: The parties agree to act in accordance with local, state and federal laws and any other regulations governing hunting and shooting. Lessee will report and testify any violation of the law or regulations and will provide assistance to the law enforcement officers.
FIRE PREVENTION: Lessee shall not cause any fire on the Leased Property. Lessee agrees to use every safety measure and exercise due care to protect the Leased Property from fire or any other damage.
ASSIGNMENT AND SUB-LETTING: Lessee shall not assign this Agreement, or sub-let or grant any license to use the Leased Property or any part thereof without the prior written consent of Landowner. A consent by Landowner to one such assignment, sub-letting or license shall not be deemed to be a consent to any subsequent assignment, sub-letting or license. An assignment, sub-letting or license without the prior written consent of Landowner or an assignment or sub-letting by operation of law shall be absolutely null and void and shall, at Landowner’s option, terminate this Agreement.
GUESTS: Lessee shall not invite or allow any other individual to accompany them or access the property at any time, unless the Landowner has provided written approval allowing this activity.
CONDITION OF PROPERTY: Lessee(s) stipulates, represents and warrants that Lessee(s) has examined the Leased Property, and that it is in good and acceptable condition at the time of this Agreement.
LANDOWNER HUNTING RIGHTS: Landowner maintains the right, and Lessee acknowledges this right, to hunt the property during the time period of this lease. This right is exclusive to only one individual, Steve Kollodge, no other acquaintance or relative of the Landowner shall have access to the land for the hunting of game.
NUMBER OF LESSEES ALLOWED: During the Term of this Lease the Landowner shall restrict the number of individuals allowed to Lease the property to two individuals. The Landowner maintains the right to hunt on the property. Including the Landowner the maximum number of people authorized to hunt on the property is three during the archery deer season. Lessee shall make reasonable accommodations not to interfere with any other Lessees or Landowner during the process of hunting. Any disputes shall be brought to the attention of the Landowner, Landowner shall determine a resolution to any dispute that shall be binding on both Lessees and Landowner.
WEAPONS: Weapons for the harvesting of Whitetail Deer is limited to legal archery equipment as defined by and in the 2021 MN Hunting regulations. No guns of any kind are allowed on the Property at any time during the Whitetail Deer Lease.
Any weapon allowed by the 2024 MN Hunting Regulations for the harvesting of Black Bear is allowed during any legal time period for the Black Bear Lease.
AGRICULTURAL ACTIVITIES: Landowner is engaged in farming practices on the described property, activities that occur include, plowing, disking, dragging, seeding, tree planting, apple harvesting, herbicide application, rock picking, mowing, grain harvesting, grain hauling, equipment maintenance, road maintenance, etc. Lessee acknowledges that agricultural activities will occur during the lease period and agrees not to interfere with these activities or otherwise damage farm fields fencing, gates or crops for any reason.
INSPECTION OF PROPERTY: Landowner and Landowner’s agents shall have the right at all reasonable times during the term of this Agreement to enter the Leased Property for the purpose of inspecting the Property. And for the purposes of making any repairs, additions or alterations as may be deemed appropriate by Landowner for the preservation of the Leased Property. The right of entry shall likewise exist for the purpose of removing placards, signs, fixtures, alterations, or additions that do not conform to this Agreement or to any restrictions, rules or regulations affecting the Leased Property.
WAIVER AND RELEASE FROM LIABILITY: No provision of this Agreement shall be considered waived unless such a waiver shall be expressed in writing as a formal amendment to this Agreement and executed by the Lessee and Landowner. Landowner shall have no responsibility or liability to Lessee or to any other individual or entity for any loss, injury, damage or death arising from anything done or omitted under this Agreement. Lessee hereby agrees, to release and hold Landowner harmless from and against any and every claim or demand, including but not limited to attorney fees, interests or any costs resulting from the Lessee activities on the Leased Property.
It is understood that Lessee accepts the Property in its, “As Is” condition. Lessee understands that there may be hidden and non-hidden hazards, including but not limited to, holes, fences, wires, posts, swamps, ponds, tree branches, harmful plants, or unauthorized persons on the Property, or other risks such as, slips, falling, risks associated with ladders, tree steps and climbing trees and ladders, tree stands and hunting from tree stands, etc, that may cause injury or death. Lessee assumes all the risk at its own responsibility, and agrees to hold Landowner harmless from and against any and all claims of loss, damages, liabilities, personal injuries, or expenses (including but not limited to, court costs and attorney’s fees) incurred as a result of any injury to or death of any person or persons or any damage to Property in any way arising out of or relating to any breach or default under this Agreement by Lessee or Lessee’s guest(s) whether authorized or not, any act or omission of Lessee or Lessee’s guest(s), or the presence or activities of Lessee or Lessee’s guest, on or about the Property.
TERMINATION: Anything in this Agreement to the contrary notwithstanding, it is expressly understood and agreed that Landowner and Lessee each reserve the right to cancel this Lease, with or without cause, at any time during the Term of this Agreement. In the event of cancellation by Lessee, all rentals theretofore paid and unearned shall be retained by the Landowner as compensation for Landowner's overhead expenses in making the Land available for lease, and shall not be refunded to Lessee.
VIOLATION OF LEASE TERMS: If Lessee is found to be in violation of any terms of this lease, written notice shall be provided to the Lessee by the Landowner. Lessee shall immediately remedy the violation to the Landowners satisfaction. If the same or additional lease term violation occurs, the Landowner shall provide a second written notice to the Lessee. Lessee shall immediately remedy the violation to the Landowners satisfaction. If a third violation of the same or other lease term occurs the Landowner may at his discretion cancel the lease and notify the Lessee that entering the property for any reason is not allowed and will be treated as Trespassing. In the event of cancellation by Landowner, all rentals theretofore paid and unearned shall be retained by the Landowner as compensation for Landowner's overhead expenses in making the Land available for lease, and shall not be refunded to Lessee.
ADDITIONAL PROVISIONS, RULES OR REGULATIONS:
1) Driving on the Property is restricted to roads designated for driving for the purpose of
retrieving harvested game.
2) Accessing the property is restricted to walking using designated access routes to enter
and exit tree stand or blind locations. Additional access trails will be designated by
the Landowner for entry and exit to certain areas based on day/night conditions.
3) The use of lights is discouraged while entering or leaving hunting locations.
4) Areas designated as deer sanctuaries shall not be accessed except for the tracking of
wounded game.
5) Deer sanctuary areas begin 40 yards from the edge of any designated walking trails
or property line.
6) No smoking or drinking of alcoholic beverages is allowed on the property.
7) No overnight camping is allowed on the property.
8) No shining of deer is allowed at any time.
